WAYNE CO.— A Xenia man who appears to continue to avoid prison time for felony sex convictions has been charged with battering a “child.”
According to information filed in the case, Charles William Wallace, 58, is charged with two felonies, Aggravated Battery and Aggravated Domestic Battery, alleging that on July 16 he caused great bodily harm to Heather Wallace, a child under the age of 13, when he threw an item at her, striking her in the face.
Wallace was convicted in Franklin County in 2001 of Aggravated Criminal Sexual Abuse of a Victim between the ages of 13-16 and sentenced to 30 months probation and ordered to pay $3,250 in fines and fees.
Then in 2003 Wallace was charged in Wayne County with Aggravated Criminal Sexual Abuse of a victim 13-16 years of age.
That charge was later reduced to Exploitation/Exposing Organs, his second to which he pled guilty and was sentenced to 30 months probation, six months home confinement and ordered to pay $1,437 in fines and fees.
He was charged in Wayne County, in 2013, with two counts of Unlawful Possession of a Controlled Substance.
Both those charges were dismissed in May of this year.
For unknown reasons Wayne County continues to be one of the most lenient counties in southern Illinois when it comes to prosecuting sex offenses.
Wallace is currently being held in the Wayne County jail on $20,000 cash bond.
